MARTINSBURG — A Glenfield man is suing the town of Martinsburg over injuries allegedly stemming from a swing mishap at its town-owned park.

Terry C. Plemons, in a lawsuit filed by Syracuse attorney Timothy P. Murphy, claims he suffered three fractures in his left leg and multiple blood clots from a June 10, 2011, incident at Whitaker Park.

The suit states Mr. Plemons was using a swing at the park when it broke, causing him to fall in a rut in the sand base. It claims the town allowed the swing and area below it to “fall into disrepair.”

Mr. Plemons is seeking unspecified damages for medical expenses, pain and suffering and loss of enjoyment of life.

A notice of claim was filed in the case Sept. 1, 2011.
