CANTON A St. Lawrence County Court judge has dismissed drug possession charges against a Stockholm woman accused of having 95 pounds of marijuana.
Martha R. Molella is accused of being the passenger in a vehicle that was stopped in August by Border Patrol agents and found to have marijuana in its trunk.
A police K9 found two hockey bags full of marijuana, court documents said.
Ms. Molella and the vehicles driver, Christopher A. Molella, were charged with first-degree criminal possession of marijuana.
In his four-page decision dated May 1, Judge Jerome J. Richards wrote that prosecutors failed to prove Ms. Molella had any control over the marijuana. He said they proved only that she was a passenger in the vehicle. Ms. Molella has been released under probation supervision and prosecutors may present the case to a different grand jury.
