A Gouverneur man accused of selling oxycodone has filed a petition in state Supreme Court alleging a violation of his writ of habeas corpus.

Troy D. Bigwarfe was convicted in October on two counts of third-degree criminal sale of a controlled substance. He was accused of selling oxycodone on different occasions in the village of Gouverneur to a drug task force police informant who was wearing a wire during the transaction.

Last month, St. Lawrence County Judge Jerome J. Richards sentenced Mr. Bigwarfe to prison for four years.

According to the petition, Mr. Bigwarfe accused Judge Richards of abusing the court process. He wrote that Judge Richards is responsible for his illegal conviction and detainment.

Court documents show Judge Richards dismissed Mr. Bigwarfe’s charges, but later reinstated them.

The case has been assigned to Judge S. Peter Feldstein, of Indian Lake.

Mr. Bigwarfe also has a pending federal conspiracy charge against him that has not been settled.

Judge Richards was not available Monday for comment.
