Judge backs Potsdam ZBA on frat house decision

CANTON — The village of Potsdam Zoning Board of Appeals acted properly when it twice denied the owners of a fire-damaged fraternity house extra time to complete repairs.

The ruling, issued this week by state Supreme Court Judge David R. Demarest, means 20 Pleasant St., Potsdam, which was the home of Delta Sigma Phi fraternity from 1954 until the building was heavily damaged by fire March 31, 2006, may be used only for single-family housing.

The fraternity, which owns the property under the name Karma Alumni Board, was granted a building permit for the building's reconstruction in November 2006 but failed to complete work within an 18-month time limit. It took the case to court after the zoning board twice refused to grant an 18-month extension.
